Terms of Service

1. The service

X404 ("the Platform", "we", "us") provides a website-building service that lets businesses ("you", "Merchant") create, customize and publish websites from professionally designed themes. These Terms govern your access to and use of the Platform.

2. Your account

You are responsible for safeguarding your account credentials and for all activity that happens under your account. You must be at least 18 years old and have authority to bind the business you register.

3. Content and your website

You retain ownership of the content you provide (your business details, text, images and products) and of the website built from it. You are solely responsible for the content of your website, including ensuring it does not infringe third-party rights, is not unlawful, and does not mislead your customers.

Some content on your website may be drafted for you by an AI service from the details you provide. You are responsible for reviewing, correcting and publishing that content — AI-generated content may be inaccurate and is provided as a starting point, not as professional or legal advice.

4. Payments

Platform subscriptions are billed through Razorpay, a third-party payment processor. Payment processing for purchases on your merchant website is handled on your own Razorpay account, or through cash-on-delivery where you enable it. We are not a party to the transaction between you and your customers.

Trial periods and plan terms are shown at signup and on the pricing page. Unless stated otherwise, subscription fees are non-refundable, and cancelling your subscription stops future billing at the end of the current period.

5. Acceptable use

You agree not to use the Platform to publish illegal content, infringe intellectual property, defraud anyone, distribute malware, or interfere with the Platform's operation. We may suspend or remove websites that violate these Terms or applicable law, and we may refuse or halt AI content generation for content that is inappropriate.

6. Intellectual property

The Platform, its themes, software and branding are owned by us or our licensors. The license granted to you is limited to using the Platform for its intended purpose; you may not resell or redistribute the themes or the Platform itself.

7. Limitation of liability

The Platform is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential damages, or for any loss of revenue, data or goodwill, arising from your use of the Platform or from any interruption or unavailability of the service.

8. Termination and deletion

You may delete your account at any time from your dashboard. Deleting your account removes your website, products, orders and associated data from the Platform. We may suspend or terminate your account if you breach these Terms.

9. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated through the Platform. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
